Do you have to learn the RCP before you write it, or can you just write it informally? How long does it take to learn the RCP?
This would be pro per (or pro se if it's spelled that way in Virginia)|||Most rules of civil procedure no longer refer to a demurer. Instead, the rules allow for a motion to dismiss for failure to state a claim, or, later, a motion for summary judgment. So, I would think that you do indeed have to study the Virginia civil procedure rules. In all likelihood if you file a demurer, it will be summarily denied as a fugitive pleading. How hard it is to write a motion to dismiss depends upon you, your education, your ability to write, your knowledge of the substantive law, etc. Yes, it must be formal, in the proper format for a motion. That format is probably described in your local rules.|||Civ. Pro. is a whole course in law school. You should retain counsel if you care about the law suit and the other side has a lawyer.
