Instead, the rules allow for a motion to dismiss for failure to state a claim, or, later, a motion for summary judgment. So, I would think that you do indeed have to study the Virginia civil procedure rules. In all likelihood if you file a demurer, it will be summarily denied as a fugitive pleading. How hard it is to write a motion to dismiss depends upon you, your education, your ability to write, your knowledge of the substantive law, etc. Yes, it must be formal, in the proper format for a motion. That format is probably described in your local rules.|||Civ. Pro. is a whole course in law school. You should retain counsel if you care about the law suit and the other side has a lawyer.
