virginia: My fiance' has visitation of his daughter, which he wants more time with her. He also pays out of the wazoo for child support, and his income was lowered. There were no official child support papers filed in the courts of Virginia. The only thing stated with the visitation and child support was with my fiance's divorce decree with his ex wife (the child's mother). You'll need to hire a lawyer, if you win, you can file for a modification and you guys will share the costs but no child support will need to be paid directly to the mother anymore. VA is one of the rare states that allows this.|||The best way is with a lawyer to help you out. Can't afford a lawyer? Find one with a payment plan. Then, look at the budget and figure out where to make cuts. Do you NEED cable/satellite TV? No, so drop it for a few months. Do you NEED brand name food items? No, so cut costs by buying more generic brands. Do you NEED to go out 3 or 4 times a week? No, so cut back to only once a week, if at all. In a nutshell, he needs to look at what is more important to him: getting joint custody, or having these frivolous items to pay for.|||file a motion to modify support and custody in the appropriate court.
