My wife was struck with a shovel (we have the shovel) by her ex-husband in Martinsville Virginia and the police never investigated the incident. (we have a forensic scientist's report) She was placed on IV's (we have the IV materials) in the home by her ex, who is a doctor, and was later rushed by helicopter for emergency surgery. For years we haven't been able to pursue this since our children were young and my wife had serious health issues to overcome. We have many, many files on this and would like to know if anyone has an idea about attempted murder statute of limitations in Virginia or if this could be developed further through a book?|||There is NO statute of limitations in any state in the US. What a very sad, sad story! I'm sorry for your pain.|||I'm not sure. But serious crimes, like this one, typically don't have statutes of limitations.
But were the polict not notified in the begining? If they were then they should have pursued the case.|||It's not your role to pursue criminal charges against another person. It's the role of the police. If you neglected to file charges at the time of the incident then it's up to the police to decide if they have legal grounds.
What you really want to do is sue for damages; however in Virginia, the statute of limitations on personal injury lawsuits is two years. Good luck.|||Wow, I am so sorry you all have been through this. While I don't have an "expert" answer, I would suggest that you call the Prosecuting attorney's office in the County where this took place and talk to him, asking him that question.
